Contant (A) will convey the terms and conditions that are associated with the property listing and may not be used as those of contant (B) which is for Photography services – vice versa. In a case of a membership plan when you (user) benefit from both these services simultaneously, being noncompliant or not abiding for either service terms and conditions indicates that you cannot use that membership plan.
1A. Property listing Service
- Realoth homes is for listing of properties by agents or agencies and allows visitors to browse through and select properties they would like and get information of the listing agent. We are a platform that display properties for potential buyers and renters to connect with the property agent.
- Realoth Homes does not offer property services as it is not a property agency and does not hold any certification to act as an: Attorney, Valuer, Advisor or conveyancer, all the properties that are displayed or appear on the website are those of agents who are using our listing services.
- In our services we are strictly for listing of properties, and we are not involved anyhow in the transaction between the buyer or renter and the property owner/agent.
2A. User conduct and restrictions
- For listing agents, it is vital to publish appropriate content on the website to avoid causing confusion to other website users or visitors. Harmful content might cause potential renters to leave the site and in such instances that you publish inappropriate content whether by fault or not you will be banned for future listing on realoth homes. We urge you as you publish a listing on our website to double check the property images or content if it’s appropriate to be listed on our website.
- As a user browsing through the website, it is required of you not to leave any harsh comment that may emotionally harm any user in any of the website pages. Living such a comment will deny future listing on the website or posting any comment as a user.
- Positive approach – we urge all users on our website to engage positively whilst using our services and as the listing agent you have to engage with the user that connected to your content or contacted you as a listing owner in a positive manner
- No website links shall be posted by listing owners or service providers that redirects to unsafe sites.
- There shall be no human or pet visible on the property images that you publish on our website, the images must stickly show the property and its features.
3A. Payments
- Paying for our services while using a credit card, we have ensured to use legitimate payment gateways to protect your card information.
- Payments for listing services that made to realoth homes are non-refundable, in a case where you want to withdraw the listing you have created.
- Shall you wish to unsubscribe or delete your profile at any time as a listing owner from our database note all payments that were already made with us will not be refunded.
- No payment from a renter shall be paid through realoth homes as we do not accept any rent on behalf of the landlord
- All payments made will run through the period provided and shall the period expire you will be required to pay again to list on the platform.
4A. Termination
Realoth homes uses membership plans for listing services
- To create a listing on realoth homes first you will have to select a membership plan, and the period of the listing depends on which membership plan you have selected.
- Once you have paid for the membership you will have to create a listing(s) and you will not have an option to terminate your plan until it expires. There will be no refunds if you already paid for your invoice
- Refunds are only paid if you cannot create a listing due to the reasons related to realoth homes system or if your listings you have created are not showing up or is not approved and you already paid your membership.
- Changing your membership plan will not result in money back or refund for the previously paid plan. The new membership plan will commence immediately after processing of payment.
5A. Information data
- By visiting and willing to provide us with any of your personal information you must carefully read the terms and conditions as we would not allow you to provide us with your information without accepting the terms and conditions.
- You must make sure that your information that you provide to us is correct, accurate and updated. we are not to be held responsible for any inconveniences that may come up if the information that you have provided is incorrect or missing.
- In case of requesting a change of password you should be in contact with us, and you shall renew your password. Passwords shall be protected at all costs, and may someone have your password and login to your profile and make changes without your consent we shall not be held responsible for such inconvenience.
- By having to share your personal information with the owner of the listing we are not to be held responsible for any misuse of your information.
- While a user has filled the form to connect with you, as a real estate agent it is necessary to protect the personal information of the user and comply with the protection of private information act, 2013.
- All useful information such as names, email addresses and contact numbers will be filled on the registration forms to become a member of realoth homes. Note that no information you will provide to realoth homes will be used for promotion and marketing purposes as we are POPI compliant and understand the risks.
- At any time, it is possible to request cancellation and all the information you have provided to realoth homes will be removed from our database.
6A. User/Client confidentiality
- Not misuse the user’s information that you have obtained when being contacted regarding the property you have listed on realoth homes rather it may be shared to others who are responsible in managing the listed property.
- Keep all the content you read or seen on the website and all of these of other users confidential and do not use it for your own benefit without the consent of realoth homes or the consent of the publisher.
- Use the information you have collected on the leads in a correct way as a realtor to connect the user to the correct property that is listed and do not sell any of the information to any third-party.
- All the links on the website are to be kept confidential at all costs such those that redirects to agencies website.
7A. Intellectual property
By visiting the realoth homes as a user you abide by all the policies mentioned on the website and will not at anyhow copy the content and context of the website.
- All the content on the website including the names, photos, icons, logos, trademarks, and the website as a whole is subject to copyright. You may not use any technological or artificial intelligence or anyhow to try to steal or copy the content or anything under realoth homes website.
8A. Warranties and Obligations
Realoth homes does not warrant that:
- Visiting or using our services there will be no inconveniences.

- Ensuring that the listing agent does have a valid practice license and is recognized by the property practioners regulatory authority (PPRA).
9A. Indemnities
- Realoth homes is a real estate directory website which host the property advertisers to list their properties and welcomes users to search their preferred properties to buy or to rent on.
- It is your own responsibility as a client listed on realoth homes website to reach to an agreement with the user that is interested to the property you have listed. Realoth homes will not be at the centre of the negotiation or any agreement that is made between the client and the user.
- By visiting or having any interest on the listed properties as a user you may not somehow forced to engage with the realtor of the listing.
10A. Customer complaints
- Shall the website cause any inconvenience while listing we may not be held responsible
- May you feel that we have done something thing wrong, or we went against our own terms and conditions, or privacy policies you may file a complaint to our email help@realothhomes.com in order for us to resolve the issue at hand. May you feel that the matter is not correctly resolved you can escalate the matter to the consumer court.
11A. Contractual disputes
- May anything cause a dispute between the realtor and the user we may not be held responsible to resolve the issue.
- We are the source of advertising properties and providing a way to build a connection between a real estate agents and potential buyers or renters, and we are not responsible for any transaction that will take place in or outside the website.
- The prices for the properties that are displayed on this website are updated by the real estate agent, may the prices change we may not be held responsible if that may cause any inconvenience.

- We strive to make every party that engages with us satisfied with the service that we do provide; we tend to solve any issue that may arise as soon as possible without even ruining an image.

1B. Bookings and Cancellations
1.1 Bookings are to be made on the platform after having read and accepted these terms and conditions and our professional will reach out to you.
1.2 Client must ensure that correct details are submitted whilst booking for our services to avoid any inconveniences.
1.3 You have 24h period to cancel or reschedule the project booked for, failure to comply with this period will result in the upfront payment not being refunded. Refer also to refund policy
1.4 Due to weather and hazardous conditions the client is required to update us within a period of an hour to cancel or reschedule the project. As such conditions might have an impact on the quality of the project.
2B. Payment
2.1 Payments are accepted on the platform (Think) via credit card and you are required to pay 25% upfront and the rest shall be processed after completion of the project.
2.2 Realoth homes also charge travelling fee of the photographer who is going to handle the project. The fee is going to be invoiced at the end of the end of the project. Learn more about the travelling surcharge.
2.4 Failure to pay for the project upon completion will result in us not supplying back the results of the project due to non-payment and the issue may be forwarded to the authorities for collection.
2.5 Payments for the project are strictly required to be settled immediately when both parties are satisfied with the results of the project.
3B. Copyright
3.1 All the results of the visual services which includes, photographs, videos etc are copyrighted by realoth homes and only the agent requested our services will have the license to use the photographs and videos not any other third-party. Third parties which may include designers, architects and so on which are working along with the licensed agent, permission must be granted by the copyright reserve realoth homes.
3.2 Realoth homes is the one who can and permitted to edit the photos and videos no other third party is allowed to modify or edit for the licensed agent, realoth homes can and will take legal action against the copyright infringement.
3.3 Realoth homes have the right to use the photographs for various purposes such as posting in other realoth homes pages.
3.4 Although the photographs and videos copyright is reserved by realoth homes we will not share or sell with any other third party.
4B. Complaints
4.1 The client has the right to complain about the quality of the service provided by us if we did not meet their expectations.
4.2 The client cannot complain directly to the photographer; all the complaints must be emailed to the us where our team of professionals can assist in resolving the issue.
4.3 The client cannot file a complaint for anything that we did not vow to deliver which are irrelevant complaint reasons, and may we not be labelled as incompetent for not solving such complaints.
5B. Client responsibilities
5.1 The property must be in a good state in order to perform video or photography services and it is with the client responsibility to ensure such and all the unnecessary things within the property are removed before the services begin.
6.2 Ensure lighting is in good condition within the property in order to have a good quality of photographs to fulfil the client’s satisfaction.
6.3 Client has the right to choose the best angles and rooms for the photoshoot, failure to do that the photographer shall use experience to make judgement on the best possible angles for the photoshoot.
6.4 It is with the client responsibility to ensure that we as service providers we have access to all perimeters of the property. Failure to grant access to certain parts of the property will therefore limit the value of the service. May we not be granted an access to the property in a case where there are no personnel to allow access, the service will result as been cancelled and the 25% upfront payment will not be refunded, and the client will be responsible to make a booking again and charges will apply.
6.5 Ensuring that the property is safe and nothing can endanger the photographer, if such tragedy can happen, we are not to be held liable for rather the client will be.
6.6 May property damage occur it is with the clients responsibility to cover for the damages.
7. Quality Assurance
7.1 Whilst we offer these virtual services, we give a 100% satisfaction guarantee.
7.2 Realoth Homes will make an effort to capture high quality photographs and videos to make the property stand beyond the competition.
7.3 In a case where the clients’ expectations are not met, Realoth Homes is willing to increase the quality by retouching on the editing part and along with the client correct all the issues that hinder the quality at no additional cost, all that is done to satisfy the needs of the client.
7.4 May the client still not be satisfied with the service, the client must file for a refund within 3 days post the delivery of the results and this also implies to the services that are included in the membership plan in the property listing.
8. Results delivery
8.1 After the photoshoot it takes around 2-3 business days to complete the editing and the results of the project will be delivered immediately after the editing part.
8.2 The client has 24hrs to view the results of the project and may be the client not be satisfied with the results, the client has to request for retake at no additional cost within that 24h period. Failure to ask for retake on time will be concluded as a successful project.
